Terms of Service

By accessing and using BotSpot ("the Platform"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

BotSpot reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform constitutes acceptance of any modifications.

To use certain features, you must register for an account. You agree to:

• Provide accurate, complete, and current information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Be at least 13 years of age (or applicable legal age)

We reserve the right to suspend or terminate accounts that violate these Terms.

As a creator on BotSpot, you are responsible for:

• Content Quality: Ensuring your AI agents, bots, and skills work as described
• Legal Compliance: Having all necessary rights to sell your content
• Accurate Descriptions: Providing truthful information about capabilities and compatibility
• Customer Support: Responding to buyer inquiries and issues promptly
• Updates: Maintaining and updating your listings as needed
• Pricing: Setting fair and transparent prices in USD

All listings must comply with our guidelines:

• AI agents, bots, or skills only
• Clear descriptions of functionality and requirements
• Accurate compatibility information
• Appropriate pricing in USD currency
• No prohibited content (see Section 8)

We review all listings before publication and reserve the right to remove any listing that violates these guidelines.

Payment Processing: All payments are processed through Razorpay. You agree to Razorpay's terms and conditions.

Pricing: All prices are displayed in USD. BotSpot does not control currency conversion rates.

Transaction Fees: Platform fees are clearly displayed before purchase. Creator revenue shares are detailed in our Pricing page.

Digital Goods: All purchases are for digital goods. Download limits apply (maximum 5 downloads per purchase).

Digital Products: Due to the nature of digital goods, refunds are generally not available once downloaded.

Exceptions: Refunds may be considered for:

• Corrupted or non-functional files
• Misrepresented products that don't match descriptions
• Technical issues preventing download

Dispute Window: All refund requests must be made within 7 days of purchase.

Process: Contact support@botspot.store with your order details and issue description.

Platform Fees: BotSpot charges fees to maintain and improve the marketplace:

• Nikhil's Listings: 100% revenue (no platform fees)
• Other Creators: 80-90% revenue share depending on volume
• Free Listings: No fees for free products

Fee structures are detailed on our Pricing page and may change with notice.

You may not use BotSpot to:

• Sell illegal, harmful, or malicious content
• Violate intellectual property rights
• Engage in fraud or deceptive practices
• Distribute malware or viruses
• Violate privacy or data protection laws
• Spam or harass other users
• Attempt to circumvent platform fees
• Reverse engineer or copy platform technology

Violations may result in immediate account termination and legal action.

Your Content: You retain ownership of AI agents, bots, and skills you create. You grant BotSpot a license to display, market, and facilitate sales of your content.

Platform Content: BotSpot's design, functionality, and technology are protected by intellectual property laws.

Third-Party Content: You must have rights to all content in your listings, including code, images, and descriptions.

BotSpot is provided "as is" without warranties. To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our liability is limited to the amount you paid for the affected service
• We are not responsible for creator content quality or functionality
• We are not liable for third-party service interruptions (Razorpay, Supabase)

We may suspend or terminate accounts for:

• Violation of these Terms
• Fraudulent or illegal activities
• Inactive accounts (no login for 12 months)
• At your request

Upon termination, you lose access to your account and content. We may retain certain information as required by law.

Governing Law: These Terms are governed by and construed in accordance with the laws of India.

Dispute Resolution: Any disputes arising from these Terms or your use of BotSpot will be resolved through:

1. Good faith negotiation between parties
2. Mediation if negotiation fails
3. Arbitration in Pune, India as final recourse

Court proceedings will be conducted in English and under Indian law.
